Unlike individuals or incorporated entities, most associations and clubs lack the legal personality to hold properties such as land or buildings in their names. As such, it is not uncommon for the properties to be vested in a professional trustee such as OSK Trustees on behalf of an association or a club. Where a trust corporation such as OSK Trustees is appointed (as opposed to trustees who themselves are members of the associations and clubs), conflict of interest situations can be avoided as OSK Trustees does not have any interest in the affairs, management or properties of the associations and clubs in question. In addition, a trust corporation has the advantage of perpetual existence. Unlike in the case where natural persons are appointed as trustees, complications with regards to the management of the trust properties arising due to the death or disability of such individuals does not occur.
